This is a continuation of our main terms of service.
1. Scheduling Policy
- By scheduling a call, you agree to respect the scheduled time and adhere to the policies outlined in this agreement.
- You are responsible for ensuring the accuracy of the date, time, and contact information provided when scheduling.
2. No-Show Fee Policy
- If you fail to attend a scheduled call without providing at least 24 hours’ notice, a $95 no-show fee will be assessed.
- This fee is applied to compensate for the time reserved and the opportunity cost of preparing for the call.
3. Payment Terms for No-Show Fees
- Invoices for no-show fees are due within 7 days of issuance.
- If payment is not received by the due date, interest will begin accruing immediately at a rate of Prime + 10%, compounded weekly.
- If the invoice remains unpaid after 45 days, the outstanding balance (including interest) will be referred to a collections agency. Additional fees may apply as per the collections agency’s policies.
4. Waiver of No-Show Fees
The no-show fee will be waived under the following conditions:
- Rescheduling: You reschedule the missed call within 7 days of the original date and complete the rescheduled call.
- Purchase of Services: You purchase any service or product from Provider within 7 days of the original missed appointment.
5. Rescheduling Policy
- Rescheduling or cancelation requests must be submitted at least 24 hours in advance of the scheduled call time.
- If you reschedule after missing a call, the no-show fee will still apply unless waived under the conditions listed in Section 4.
- Violation of this policy will be considered a no-show and the policy in section 2 and section 3 will be in effect.
6. Emergency Exceptions
- If a legitimate emergency prevented attendance, you may contact Provider within 7 days of the missed call to request a fee waiver.
- Waivers for emergencies are granted at the sole discretion of Provider and may require supporting documentation.
7. Acknowledgment of Agreement
- By scheduling a call, you confirm that you have read, understood, and agreed to these Terms of Service.
- This agreement is enforceable as part of the broader Terms of Service for Provider.
The below terms specifically relate to an intro call where the client selected to proceed with a Cyber Security Consult.
1. Cybersecurity Proof of Concept Commitment
- By selecting to proceed with a cybersecurity proof of concept (PoC), you agree to fully engage in the process, which includes:
- Providing Necessary Access and Information:
To complete the assessment, you agree to provide the following within 30 days of confirming your commitment:- Remote Access: Temporary, secure remote access to any computers or systems you want included in the PoC.
- Microsoft 365 or Google Workspace Tenant Permissions: Administrative permissions (delegated or direct) to ensure thorough assessment of potential vulnerabilities in your accounts and configurations.
- Website and IP Information: A list of any websites or IP addresses you want evaluated for vulnerabilities.
- Active Participation: Engaging in follow-up discussions to review findings, recommendations, and the results of the PoC.
- Timely Completion: Ensuring all required access and information are provided within the specified timeframe to enable Provider to deliver the PoC effectively.
- Providing Necessary Access and Information:
- This commitment is final and binding. Failure to fulfill the outlined responsibilities will result in enforcement actions as described in Section 2.
2. Back-Out Fee for Failure to Complete
- Once you agree to proceed with the cybersecurity proof of concept, you are fully committed to completing the process.
- If you fail to provide the required access, information, or participation as outlined in Section 1, or if you otherwise fail to complete the PoC process, you will be assessed a non-refundable back-out fee of [$350] to compensate for the time and resources allocated by Provider.
- This fee is enforceable immediately upon failure to comply with the terms of the commitment and will be invoiced to you within [7 days] of the determination of non-compliance.
3. No Cancellations or Opt-Outs
- Once the cybersecurity proof of concept is agreed to, no cancellations or opt-outs are permitted. By committing to the PoC, you acknowledge that the engagement involves resource allocation, planning, and execution that cannot be retracted without detriment to Provider.
- Failure to proceed will result in the full enforcement of the back-out fee as described in Section 2.
4. Enforcement of Commitment
- Provider reserves the right to:
- Enforce the back-out fee through invoicing and, if necessary, collections.
- Decline future consultations or services for repeated failures to adhere to commitments.
- Publicly rescind any previously extended goodwill offers or discounts as a result of non-compliance.
5. Agreement to Terms
- By scheduling an introductory call and selecting to proceed with the cybersecurity proof of concept, you confirm that you have read, understood, and agreed to these Terms of Service.
- This agreement is binding and enforceable as part of the broader Terms of Service for Provider.
